OneTwo Stop Portable Sanitation Inc. · Credit account version of the Portable Restroom Rental Agreement (v2026-05). These terms apply to every rental under the credit account, form part of the Commercial Credit Application above, and are accepted by the signature in Section 7. Where these terms and the application differ, the application governs.
These terms are between the customer named in Section 1 (the “Lessee”) and OneTwo Stop Portable Sanitation Inc. (the “Lessor”). If a management agent orders a rental on behalf of a third party, the management agent is jointly and severally responsible with that third party and is treated as the Lessee.
The Lessee agrees to rent portable restrooms (“Equipment”) from the Lessor in the units ordered from time to time, on these terms. Any problem with the condition of the Equipment must be brought to the Lessor’s attention on delivery. If the Lessee cancels an order before delivery, an administration fee of thirty per cent (30%) of the first billing cycle’s rental charge applies, plus any labour or material costs the Lessor incurred to prepare the Equipment. Deposits, if any, are non-refundable.
1.1 The rental period is one (1) cycle of twenty-eight (28) days. The minimum rental is one (1) billing cycle, and rentals are billed per 28-day cycle in advance.
1.2 Payment terms for credit accounts, including the due date, credit limit and late payment schedule, are set out in Sections 4 and 5 of the Commercial Credit Application.
2.1 There is no credit for part of a billing cycle. Rental charges are not pro-rated.
2.2 If the Lessor is unable to remove the Equipment when requested due to factors outside its control, the Lessee is responsible for charges up to the day the Equipment is actually removed.
2.3 There is no credit for release of the Equipment before the agreed release date, except as expressly agreed with the Lessor and confirmed in writing.
2.4 The rental charge per billing cycle includes one cleaning per week unless otherwise stated.
2.5 Additional cleanings are available at an extra cost.
2.6 Moving the Equipment to a new site incurs additional charges.
2.7 Prices are subject to change without prior notice.
3.1 Equipment may not be sublet or assigned without the Lessor’s prior written consent.
3.2 The Lessor may suspend service or terminate the rental and retrieve the Equipment in cases of non-payment, breach of these terms, or mishandling of the Equipment. For non-payment, the Lessor follows the late payment schedule in Section 5 of the Commercial Credit Application.
4.1 The Lessee agrees to defend, indemnify and hold harmless the Lessor, its officers, directors, employees, agents, successors and assigns from any claims or damages resulting from use of the Equipment.
4.2 The Lessee shall maintain general liability insurance during the rental period.
4.3 The Lessor’s total liability is limited to the value of goods and services ordered.
5.1 The Lessee agrees to keep the Equipment in an accessible and clean location for servicing.
5.2 The Lessee is responsible for obtaining any required city, township or landowner permissions. No credit is issued for removal of Equipment at delivery, or before the requested pickup date, due to lack of permission.
6.1 The Lessee assumes full responsibility for all damage, including freezing from power loss, fire or lightning, vandalism, theft, windstorm, falling objects and other unforeseen events.
6.2 The Lessee must return the Equipment in good condition, normal wear and tear excepted.
6.3 The Lessee will be charged for any defacement, including graffiti, posters or scratches.
6.4 If Equipment is damaged, dismantled or not returned, the Lessee is responsible for the full repair or replacement cost.
6.5 If Equipment is inaccessible at cleaning time, a 10-minute grace period applies. After that, no cleaning occurs. Additional cleaning trips may be scheduled for an added fee.
6.6 If the Lessee does not notify the Lessor when Equipment is no longer needed, rental continues until the Equipment is made accessible for pickup.
6.7 Extra cleaning due to vandalism, malicious acts or storm damage is charged to the Lessee.
6.8 If Equipment is deemed a total loss, the Lessee must pay the full replacement value.
